Right to information
Principle
Everyone has the right to be informed about their state of health.
You also have the right to express your wish to remain unaware of a diagnosis or prognosis. Information concerning you is confidential.
Situation of minors
Patients who are minors have the right to receive information about themselves, in a manner appropriate to their degree of maturity.
Parents or guardians receive information about the minor's state of health.
However, the minor may demand that the secret be kept from the holders of parental authority.
Situation of protected adults
The information is provided to protected adults in a manner adapted to their ability to understand. This information is also given to the person in charge of a legal protection measure with personal representation.
It can be issued to the person in charge of a legal protection measure with personal assistance if the protected adult expressly consents.
Right to consent
Principle
Every person makes decisions about his or her own health, taking into account the information and recommendations provided by the healthcare professional.
No medical procedure or treatment can be carried out without your free and informed consent. This consent may be withdrawn at any time.
Situation of minors
Consent to treatment for minor patients is given by their legal representatives (parents or guardians). The minor's consent is systematically sought if he/she is capable of expressing his/her wishes and participating in the decision.
In cases where refusal of treatment by the person with parental authority or the guardian could have serious consequences for the health of the minor patient, the doctor provides the necessary care.
Situation of protected adults
- The patient is the subject of a legal protection measure with assistance: the patient consents alone to care. The person in charge of the protective measure does not consent to care.
- The patient is the subject of a legal protection measure with representation: her consent must be obtained if she is capable of expressing her wishes (and insert the rest of the paragraph, which remains the same).
Except in emergencies, the protection judge authorizes one or the other to make the decision.
In the event of refusal by the person in charge of the protective measure, which could have serious consequences for the patient's health, the doctor provides the necessary care.
Person of trust
At any time during your stay, you are invited to designate a trusted support person (parent, relative or attending physician) in writing to the medical secretary or the care department.
At your request, this trusted support person can assist you with any formalities and be present during a consultation, examination or hospitalization.
Furthermore, if you are unable to receive information and/or express your wishes regarding medical care, your trusted support person will be consulted about your wishes, before any other person.
An information flyer is given to you on admission at the admissions office. You can also enter your wishes in the digital "My Health Space".
Advance directives
Advance directives are the expression of your wishes regarding the end of your life, in the event that you are unable to express your wishes. You can make known your wishes regarding the possibility of limiting or stopping current treatments.
Writing your advance directives will also help guide your trusted support person.
To help you, the Center provides you with an information documentan model advance directivesand a card entitled " J'ai rédigé mes directives anticipées " (" I have drawn up my advance directives "), enabling you to indicate that you have drawn them up and to whom you have entrusted them. Ask for them from your caregivers or the ERI.
You can also enter them in the digital "My Health Space".

Your patient file
Creating and accessing your file
A medical file is created for each patient within the establishment. It contains all the health information concerning you.
Your medical records are kept in a secure, suitable place on the Centre's premises. The file is kept for a minimum of 20 years.
Using the duly completed and signed form (available from medical secretariats, or online), together with supporting documents relating to your situation, you can access this information directly or through a doctor you designate.
You can consult this information on site, or request it to be sent by post.
The information thus requested will not be made available to you until at least forty-eight hours after your request, but must be communicated to you within eight days at the latest. If, however, the information is more than five years old, this period is extended to two months.
My health space
Since January 1, 2022, every citizen has been able to benefit from the "Mon Espace Santé" service.
Mon espace santé is a personal, secure digital space offered by the French health insurance scheme, Assurance Maladie, and the Ministry of Health, which is intended to become the digital health record for all insured persons.
Thanks to this service, everyone can play an active part in monitoring and preserving their health. You can store documents and health data in complete confidentiality. It's a secure space, with all data hosted in France. It can contain details of your GP, your trusted support person, your allergies, your advance directives.... It can be read by emergency service doctors, your GP and any doctors you authorize.
Unless you notify us to the contrary, the Centre François Baclesse supplies your health space with liaison letters and discharge prescriptions, outpatient medical biology reports, medical imaging reports (excluding teleradiology) and operative reports. Other documents will gradually be integrated into your health space.

Third-party access to file
For patients who are minors, the right of access to their medical records is exercised by their legal representative (holder of parental authority or guardian). The minor may, however, request that such access be granted only through the intermediary of a physician.
For adults subject to a legal protection measure with personal representation, the right of access to their medical records is exercised by the person in charge of the measure.
When the adult is the subject of a legal protection measure with assistance, the person in charge of assistance may access this information with the patient's express consent.
In the event of death, the patient's beneficiaries, i.e. his/her heirs and partner, may request access to his/her file in order to find out the cause of death, defend the memory of the deceased or assert their rights.
A patient's legal representatives or beneficiaries must provide the documents and information requested for any communication of medical records (see above), as well as proof of their status as legal representatives or beneficiaries. You can use the form for requesting access to a medical file for a beneficiary, available from the medical secretariats and the ERI.
Access to your file by outside professionals
Your medical record is a vital source of information to ensure the coordination and continuity of care both inside and outside the hospital.
The healthcare professionals at the Centre François Baclesse who are members of the team caring for you, and the doctor(s) you have designated, may have access to all the information contained in your file.
Through our e-health tools, you will also be able to authorize the healthcare professionals of your choice to access your file. The proposed system includes :
- a letter from the Centre François Baclesse doctor to the doctors you have designated,
- secure Internet access for these doctors to their medical records.
The DMP, a shared medical file
All care and hospital structures are encouraged to include the essential contents of the medical file, along with biological and imaging results. It may also contain the patient's advance directives and contact details for the trusted support person chosen by the patient. It can be read by emergency service doctors, the attending physician and doctors authorized by the patient.
Express yourself
All patients and members of their families have the right to express their views to the Center, to help improve the quality and safety of care provided.
In the event of a malfunction, your first point of contact is the nursing and administrative team who took care of you, to answer your questions and queries.
In the event of dissatisfaction, your complaint can be expressed :
- orally and recorded in writing by a member of staff who will pass it on,
- or by writing to the Managing Director.
The General Manager undertakes to reply as soon as possible.
Your complaint will also be forwarded to the users' commission for information and advice.
A mediator may be called in at your request or at the suggestion of the General Manager. The mediator may be a doctor or a non-physician, depending on the subject of your complaint. During mediation, you may ask to be accompanied by a user representative, a member of the users' commission.
A report will be sent to you, the members of the users' commission and the general manager.
Report incidents to ensure safe care
If you notice an error in treatment, medication, identity, etc., you can also report the event to the Quality and Risk Management Department: cfb-qual@baclesse.unicancer.fr
All reports are analyzed in order to implement corrective and preventive measures.

You can also share your satisfaction with the teams or with General Management, by post or email. General Management will pass on the testimonials to the care teams.
Users' commission (CDU)
Users' Commission
The Users' Commission (CDU) ensures that users' rights are respected and helps to improve the quality of care provided to patients and their families. It is informed of all complaints, claims or praise received by management, mediation reports, the results of satisfaction questionnaires and your comments and suggestions.
The Users' Commission plays an active role in the Center's quality policy, as well as in the facility project.

Processing your personal data
Principle
The Centre François Baclesse is particularly committed to respecting privacy and protecting personal data. It therefore implements appropriate measures to ensure the protection, confidentiality and security of your personal data.
All our data processing is secure and takes place in strict compliance with medical secrecy, Regulation (EU) No. 2016/679 on the protection of personal data (RGPD) and the French Data Protection Act (Loi Informatique et Libertés) No. 78-17 of January 6, 1978, amended by Act No. 2018-493 of June 20, 2018 on the protection of personal data.
What types of data are processed?
The professionals who take care of you, whether on admission, during consultations or in the context of research, collect and formalize information concerning your administrative, medical, social or video-surveillance data.
Why do we use this data?
This information is recorded in your computerized patient record or within the information system, and is used in a variety of ways to :
- Facilitate the administrative and medical management of your case,
- Participate in follow-up and continuity of care,
- Enable procedures to be paid for by health insurance and mutual insurance companies,
- Respond to surveys and regulatory requirements,
- Contribute to research* and health monitoring (registers, observational studies, etc.),
- Secure premises with video surveillance.
*Forresearch purposes, the data collected and generated during your treatment or follow-up will be used confidentially, and the anonymized and aggregated scientific results will in no way allow you to be identified.
Who receives the data?
Access to your data is strictly limited within the establishment to those persons who are required to have knowledge of it by virtue of their duties, i.e. the care and technical teams who follow you, as well as the administrative departments responsible for managing your file, the Medical Information Department (DIM), or the technical departments responsible for monitoring the establishment.
Some of your data may also be accessible to third parties within the establishment, in particular to service providers or any entity or organization, under private or public law, required to process this data by virtue of a legal, regulatory, contractual or research obligation. For example, your data is shared within the framework of the Réunions de Concertation Pluridisciplinaire (RCP), and transmitted within the "Mon Espace Santé" service available to every citizen.
As part of your treatment, you may be offered the opportunity to take part in a clinical trial. You will be given specific information and asked to give your written consent. In addition, as part of your treatment, we may take samples which, unless you object, may be used for research purposes at a later date.
Your rights
Within this framework, you have the following rights:
- data access,
- rectification of erroneous data,
- erasure of data in the event of unlawful processing,
- portability of data collected by the establishment,
- limitation of data processing,
- to object to the processing of your personal data
- to object to the transmission of data covered by professional secrecy that may be used for research purposes.
Opposition to data processing
You have the right to object at any time to the re-use of data contained in your file, without having to justify your refusal, unless a legal obligation requires your data to be processed. This opposition will have no impact on your care or your relationship with the medical team.
